1. About Van Vakarnee

In these Terms and Conditions:

  • Site means vanvakarnee.com;
  • we, us, and our mean Van Vakarnee;
  • you and your mean the person using the Site or placing an order.

Van Vakarnee is operated by Technical Promotions Australia, ABN 19 701 360 761.

The Site sells wall art, including made-to-order photographic prints and canvas products. The Site may also sell other artwork, gift, art supply, camera supply, or related products from time to time.

2. Changes to these Terms

We may update these Terms and Conditions from time to time.

The version published on the Site at the time you use the Site or place an order is the version that applies to that use or order.

3. Privacy

Your use of the Site is also subject to our Privacy Policy.

4. Product information

4.1 Product descriptions

We aim to describe and display products as accurately as reasonably possible.

However:

  • colours and brightness can vary between screens, devices, browsers, and display settings;
  • product images may be shown in styled rooms or mockups for illustration;
  • frames, props, furniture, and accessories are not included unless expressly stated;
  • printed products may have minor variations that are normal for the printing process;
  • canvas products may have minor variations caused by printing, stretching, or finishing; and
  • some products are made to order, so there may be slight differences between batches.

You should read the product description carefully before ordering, including the selected size, format, finish, and whether a frame is included.

4.2 Product availability

Product availability can change at any time.

We may withdraw, vary, or discontinue products, sizes, finishes, collections, or options without notice, subject to any order already accepted by us and any rights you have under Australian Consumer Law.

5. Pricing and GST

5.1 Prices

All prices are shown in Australian dollars unless stated otherwise.

Prices may change at any time before you place an order.

5.2 GST

Where GST applies, prices will be displayed in accordance with Australian law.

5.3 Errors

We try to ensure pricing and product information is accurate. However, errors may occur.

If there is an obvious pricing, product, or listing error, we may contact you to correct the issue, cancel the affected order, or refund any amount paid for the affected item, where permitted by law.

6. Orders

6.1 Placing an order

When you place an order, you are making an offer to purchase the selected product or products subject to these Terms and Conditions.

6.2 Order acceptance

An order is accepted when we send an order confirmation or otherwise confirm acceptance, including by processing or dispatching the order.

We may decline or cancel an order where reasonably necessary, including where:

  • we suspect fraud or misuse;
  • there is an obvious listing or pricing error;
  • the product is unavailable;
  • production is not reasonably possible;
  • delivery is not available to your location; or
  • we are legally required or permitted to do so.

If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled item or order.

6.3 Your order details

You are responsible for checking your order details before submitting your order.

This includes:

  • email address;
  • shipping address;
  • product selection;
  • size;
  • format;
  • finish;
  • quantity; and
  • any other order options.

If you provide an incorrect shipping address and the item is delivered to that address, returned to sender, or needs to be resent, you may be responsible for any additional shipping or redelivery costs, unless the issue was caused by us or the law requires otherwise.

7. Made-to-order products

Many Van Vakarnee products are made to order.

This includes items produced to the size, format, finish, or product option you select at checkout.

Because made-to-order products are produced specifically for your order, we do not accept change of mind returns, exchanges, or refunds for those products unless we choose to offer one at our discretion.

This does not limit your rights under Australian Consumer Law.

8. Payment

8.1 Payment methods

Available payment methods will be shown at checkout.

By placing an order, you authorise us and our payment providers to charge the total amount payable for your order.

8.2 Payment security

Payments are processed by third-party payment providers.

We do not store full payment card details on our servers.

9. Shipping and delivery

9.1 Delivery estimates

Any dispatch, production, or delivery timeframe shown on the Site is an estimate only.

Production and delivery times may vary due to order volume, product type, delivery location, carrier delays, peak periods, supply issues, weather events, public holidays, or other circumstances outside our reasonable control.

9.2 Delivery locations

We ship to locations shown at checkout.

If a delivery location is not supported, the checkout may not allow the order to be completed.

9.3 Tracking

Where tracking is available, tracking details will usually be provided after dispatch.

Tracking updates are controlled by the carrier and may take time to appear.

9.4 Delivery address

You are responsible for providing a complete and accurate delivery address.

We are not responsible for delivery issues caused by incorrect or incomplete address details supplied by you, unless the issue was caused by us or the law requires otherwise.

9.5 Authority to leave

If you request authority to leave, safe drop, or delivery without signature, you accept the risks associated with that request, including theft, weather exposure, or damage after delivery, unless the law provides otherwise.

9.6 Risk and title

Title in the products passes to you once full payment has been received.

Risk in the products passes to you when the products are delivered to the address nominated in your order, unless the law provides otherwise.

10. Returns, remedies, and Australian Consumer Law

10.1 Returns Policy

Our Returns Policy forms part of these Terms and Conditions.

Please read the Returns Policy before placing an order.

10.2 Change of mind

We do not accept change of mind returns, exchanges, or refunds for made-to-order products.

This includes where:

  • you ordered the wrong size, format, or finish;
  • you changed your mind after purchase;
  • the artwork does not suit your space;
  • you found another product elsewhere;
  • you no longer want the item; or
  • there are minor variations that are normal for printed or canvas products.

10.3 Faulty, damaged, or incorrect items

If your item arrives faulty, damaged, materially different from its description, or not as ordered, you may be entitled to a remedy under Australian Consumer Law.

Depending on the issue, the remedy may include a repair, replacement, refund, or another remedy required by law.

10.4 Requesting a remedy

Remedy requests should be submitted through the Contact Us form on the Site, in line with our Returns Policy.

We may ask for supporting evidence, including photos or video, to assess the issue fairly.

We may also ask for the item to be returned for inspection where reasonably necessary.

10.5 Consumer guarantees

Nothing in these Terms and Conditions or our Returns Policy excludes, restricts, or modifies any consumer guarantee, right, or remedy you may have under Australian Consumer Law that cannot be excluded, restricted, or modified.

11. Promotions, discounts, and gift cards

If we offer discount codes, sales, or promotions:

  • they apply only in the way described in the promotion;
  • they may be changed or withdrawn at any time, subject to law;
  • they cannot be exchanged for cash;
  • they may have expiry dates or product exclusions;
  • unless stated otherwise, only one discount code may be used per order.

If we offer gift cards, additional gift card terms may apply and will be provided at the time of purchase or use.

12.2 Purchased products

When you buy a physical print, canvas, or other product, you are buying the physical item only.

You do not receive ownership of copyright or other intellectual property rights in the artwork, photograph, image, design, or Site content.

Unless we give prior written permission, you must not:

  • copy or reproduce the artwork;
  • scan, photograph, digitise, or recreate the artwork for reuse;
  • sell copies or reproductions;
  • upload the artwork for commercial use;
  • use the artwork in advertising, branding, merchandise, or resale products;
  • distribute or publish the artwork; or
  • otherwise commercially exploit the artwork or Site content.

13. Reviews, comments, and user content

If you submit reviews, comments, photos, testimonials, or other content to the Site or to us, you must ensure your content is accurate, lawful, and not misleading, offensive, defamatory, or infringing.

You grant us a non-exclusive, royalty-free right to use, reproduce, display, and publish that content for Site, marketing, and promotional purposes, unless prohibited by law.

We may moderate, remove, or decline to publish user content where we reasonably consider it inappropriate, misleading, unlawful, irrelevant, or inconsistent with our Site standards.
